COMPLAINTS 

CT06-007      In the Matter of the Complaint filed by Pam Lutter, Ramona, South Dakota, against Dish Network Regarding a Do Not Call Complaint.   

On October 26, 2006, Pam Lutter filed a formal complaint against DISH Network. Complainant claims her residence received telephone solicitation phone calls from DISH Network despite the fact the phone number is on the South Dakota Do Not Call list. Complainant seeks to have the Public Utilities Commission help resolve this matter by enforcing the Do Not Call rules, including but not limited to the imposition of any fine or penalty if informal resolution cannot be reached.

ELECTRIC 

EL06-027      In the Matter of the Petition for Declaratory Ruling of Tatanka Wind Power, L.L.C. Regarding a Proposed Wind Power Facility in McPherson County, South Dakota. 

On October 26, 2006, Tatanka Wind Power, LLC ("Tatanka") and its parent company Acciona Wind Energy USA, LLC ("Acciona") have proposed the Tatanka Wind Farm, which will consist of up to 120 wind-powered generators to yield a new capacity of up to 180 MWs.  As presently envisioned, however, the South Dakota portion of the project will consist of approximately 90 MWs of generating capacity.  In connection with this project (the "Project"), a question has arisen as to whether the South Dakota Public Utilities Commission has jurisdiction over the Project, therefore subjecting the Project to the statutory permit requirements of SDCL 49-41B and ARSD 20:10:22. Thus, Tatanka has filed a petition for a declaratory ruling pursuant to SDCL § 1-26-15 and ARSD 20:10:01:34.

TELECOMMUNICATIONS 

TC06-182      In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and DIECA Communications, Inc. d/b/a Covad Communications Company.   

On October 27, 2006 the Commission received a filing for the approval of an amendment to the Interconnection Agreement between Qwest Corporation and DIECA Communications, Inc. d/b/a Covad Communications Company regarding special promotion for inventory collection sites.  Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than November 16, 2006.  Parties to the Agreement may file written responses to the comments no later than twenty days after service of the initial comments.

TC06-183      In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and Avera Communications, L.L.C.   

On October 27, 2006 the Commission received a filing for the approval of an amendment to the Interconnection Agreement between Qwest Corporation and Avera Communications, LLC to incorporate the Triennial Review Order and the Triennial Review and Remand Order into the Interconnection Agreement.  Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than November 16, 2006.  Parties to the Agreement may file written responses to the comments no later than twenty days after service of the initial comments.

TC06-184      In the Matter of the Filing by Long Lines Wireless, LLC for Designation as an Eligible Telecommunications Carrier.   

On October 30, 2006, Long Lines Wireless, LLC filed a petition for designation as an eligible telecommunications carrier in South Dakota for the following service area: the counties of Union, Clay, Yankton, Bon Homme, Lincoln, Turner, Minnehaha, McCook, Lake, Moody, Brookings, Jackson, Harding, Butte, Lawrence, Custer, Fall River, Bennett, Perkins, Meade, Pennington, Shannon, and Haakon. Long Lines Wireless will provide service to requested service area via its own facilities, not through any resale methods.

TC06-185      In the Matter of the Filing for Approval of a Master Services Agreement between Qwest Corporation and Trans National Communications International, Inc. 

On October 31, 2006, the Commission received a filing for the approval of a commercial agreement between Qwest Corporation and Trans National Communications International, Inc relating to the provisioning of switching and shared transport.  Despite Qwest's belief this agreement should not be subject to the filing obligations under Section 252 of the Telecommunications Act, Qwest filed the agreement in compliance with the Commission's Order dated October 29, 2004, in Docket TC04-144.  Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than November 20, 2006. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

TC06-186      In the Matter of the Application of Capital Telephone Company, Inc. for a Certificate of Authority to Provide Local Exchange Services in Exchanges Served by Qwest. 

On November 1, 2006, Capital Telephone Company, Inc. filed an application seeking a Certificate of Authority to provide competitive local exchange services, interexchange telecommunications services and operator services in South Dakota exchanges served by Qwest.
