EL09-009        In the Matter of the Application of Northern States Power Company d/b/a Xcel Energy for Authority to Increase its Electric Rates.

            Application by Northern States Power Company (NSP) for approval to increase rates for electric service to customers in its service territory by approximately $18.6 million annually or approximately 12.7% based on NSP's 2008 test year. Of this increase in base rates, approximately $2.9 million is currently being collected through NSP's Transmission Cost Recovery Rider and Environmental Cost Recovery Rider, which NSP is proposing to subsequently recover in base rates. Consequently, the annual increase in overall retail rates is approximately $15.7 million or approximately 10.65%. The company states a typical residential electric customer using 750 kWh per month would see a net increase of 12.4 percent, or $8.55 per month. The proposed rates may potentially affect approximately 81,000 customers in NSP's service territory.

EL09-010        In the Matter of the Filing by Black Hills Power, Inc. for Approval of Tariff Revisions.

            On June 30, 2009, Black Hills Power, Inc. ("Black Hills") filed an application with the Commission for approval of revisions to its Sample Forms due to the conversion to a new billing system.  Black Hills has requested an effective date of August 1, 2009, for the tariff revisions.

EL09-011        In the Matter of the Filing by Montana-Dakota Utilities Co. for Approval of Tariff Revisions.

            Application by Montana-Dakota Utilities Co. for approval to revise its Occasional Power Purchase Non-Time Differentiated Rate 95, Short-Term Power Purchase Time Differentiated Rate 96 and Long-Term Power Purchase Time Differentiated Rate 97. The filing is made in compliance with the Commission's Order in F-3365 and in accordance with the Special Terms and Conditions of these tariffs which state that the rate schedules will be reviewed annually and revised when necessary.

EL09-012        In the Matter of the Petition of MidAmerican Energy Company for Approval of a Fuel Clause Rider Tariff Change.

            Application by MidAmerican Energy Company for approval of allowing the costs and results of hedging the cost of fuels used in electric generation for startup or operational stabilization of coal-fired generation and for diesel fuel associated with coal transportation contracts with railroads to be passed through the Electric Energy Cost Adjustment. MidAmerican is seeking an approval date retroactive to February 1, 2009, the first month in which hedged oil costs were included in the EECA. If the Commission does not grant the accompanying Petition, MidAmerican will remove all oil hedging
costs passed through the EECA, currently estimated at approximately $350, via a credit to the EECA in the month immediately following the Commission's order.

GD09-002       In the Matter of the Filing by H & I Grain Company for Approval of a Waiver of ARSD 20:10:12:14.

On June 29, 2009, H & I Grain requested additional time to comply with specific requirements of the grain buyers' administrative rules.  On June 30, 2009, H & I Grain and Commission Staff submitted a request for a 30 day ARSD 20:10:12:17 waiver of ARSD 20:10:12:14.  Specifically, the request requires H & I Grain submit reviewed financials to the Commission within thirty days to retain a Class A grain buyer's license.

OC09-004       In the Matter of the Complaint filed by Northern Hills Transport, LLC/South Dakota Network, LLC, Sioux Falls, South Dakota, against Haywire Fencing, Belle Fourche, South Dakota.

On June 30, 2009, William P. Heaston of Northern Hills Transport, LLC/South Dakota Network, LLC filed a complaint against Haywire Fencing alleging violations of SDCL 49-7A-5, 49-7A-10 and 49-7A-12.  The complaint alleges Haywire Fencing drilled holes for chain link fence poles at 2900 W. 10th Street, Sioux Falls, SD 57104, on behalf of the SDDOT without making a locate request.  Fiber optic cable was cut.

On July 1, 2009, the Commission received a filing for approval of a Resale Agreement between Qwest Corporation and Easton Telecom Services, LLC.  Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than July 21, 2009.  Parties to the Agreement may file written responses to the comments no later than twenty days after service of the initial comments.
