Electric

1.     EL12-029     In the Matter of the Application of Black Hills Power, Inc. for Approval of its Environmental Improvement Adjustment (Staff Analysts: Jon Thurber, Brittany Mehlhaff, Staff Attorney: Ryan Soye)

On April 16, 2012, Black Hills Power, Inc. (BHP) filed for Commission approval of its revised Environmental Improvement Adjustment (EIA). This application provides the second year revenue requirement and customer rates for the environmental improvements made to the Wyodak Power Plant approved in EL11-001, along with the project cost true-up and an annual true-up. The Company proposes a June 1, 2012, effective date.

     TODAY, shall the Commission assess a filing fee in the amount of $50,000 to account for actual expenses incurred in review of this filing commencing from the filing date?

Natural Gas

1.     NG12-002     In the Matter of the Filing by MidAmerican Energy Company for Approval of Its 2011 Economic Development Activities and 2012 Proposed Budget (Staff Analyst: Patrick Steffensen, Staff Attorney: Kara Semmler)

     On April 12, 2012, MidAmerican Energy Company filed for Commission approval of its 2011 Economic Development Annual Report and 2012 Economic Development Plan. The filing includes MidAmerican Energy Company's report on 2011 economic development activities, actual budget for 2011, and planned budget for 2012.

     TODAY, shall the Commission approve MidAmerican's 2011 Economic Development Activities and 2012 Proposed Budget?

Telecommunications

1.     TC12-028     In the Matter of the Filing by Knology of the Plains, Inc. for Approval of Revisions to its Access Services Tariff No. 1 (Staff Analyst: Patrick Steffensen, Staff Attorney: Karen Cremer)

On March 14, 2012, Knology of the Plains, Inc. (Knology) filed for approval of revisions to its Intrastate Domestic Access Services Tariff. This filing makes revisions to reflect the addition of language for the implementation of the intercarrier compensation regime for certain VoIP-PSTN traffic as mandated in the Federal Communications Commission's Report and Order and Further Notice of Proposed Rulemaking in WC Docket No. 10-90, etc., FCC No. 11-161 (released November 18, 2011) "FCC Order." The company requests an effective date for this revision of March 15, 2012. On April 18, 2012, Knology filed its responses to staff's first and second data requests. On May 1, 2012, the Commission received revisions to section 2 incorporating additional VoIP-PSTN clarification language.

     TODAY, shall the Commission approve the requested tariff changes?

2.     TC12-030     In the Matter of the Application of Onvoy, Inc. dba Onvoy Voice Services for a Certificate of Authority to Provide Local Exchange Services in South Dakota (Staff Analyst: Patrick Steffensen, Staff Attorney: Kara Semmler)

On March 27, 2012, the Commission received a filing from Onvoy, Inc. dba Onvoy Voice Services (Onvoy) for a Certificate of Authority to Provide Facilities-Based and Resold Local Exchange Telecommunications Services in South Dakota.

     TODAY, shall the Commission grant the Certificate of Authority to Onvoy, Inc?

3.     TC12-032     In the Matter of the Filing by SSTELECOM, Inc. for Approval of Revisions to its Intrastate Switched Access Tariff No. 1 (Staff Analyst: Patrick Steffensen, Staff Attorney: Karen Cremer)

On April 6, 2012, SSTELECOM, Inc. filed for Commission approval of revisions to its Intrastate Switched Access Tariff No. 1. In this filing, SSTELECOM is including exceptions to the recently approved revisions to Local Exchange Carriers Association's (LECA) South Dakota Access Tariff No. 1 (LECA Tariff). On March 27, 2012, the South Dakota Public Utilities Commission approved the revisions to the LECA tariff regarding Toll VoIP-PSTN traffic per the Federal Communication Commission (FCC) Report and Order in WC Docket Nos. 10-90, FCC Release No, 11-161 (November 18, 2011). These approved revisions have an effective date of December 29, 2011.

4.     TC12-033     In the Matter of the Filing by Sancom, Inc. dba Mitchell Telecom for Approval of Revisions to its Intrastate Switched Access Tariff No. 1 (Staff Analyst: Patrick Steffensen, Staff Attorney: Karen Cremer)

On April 6, 2012, Sancom, Inc., dba Mitchell Telecom (Sancom) filed for Commission approval of its revisions being filed to its South Dakota Switched Access Services Tariff No. 1. In this filing, Sancom is including exceptions to the recently approved revisions to Local Exchange Carriers Association's (LECA) South Dakota Access Tariff No. 1 (LECA Tariff). On March 27, 2012, the South Dakota Public Utilities Commission approved the revisions to the LECA tariff regarding Toll VoiP-PSTN traffic per the Federal Communication Commission (FCC) Report and Order in WC Docket Nos. 10-90, FCC Release No. 11-161 (November 18, 2011). These approved revisions have an effective date of December 29, 2011.

5.     TC12-034     In the Matter of the Filing by Sprint Communications Company L.P. for Approval of Revisions to its Access Services Tariff No. 3 (Staff Analyst: David Jacobson, Staff Attorney: Kara Semmler)

On April 17, 2012, Sprint Communications Company L.P. (Sprint) filed for Commission approval of revisions to its South Dakota Access Service Tariff No. 3. The revisions add clarifying language regarding the Rating of Toll VoIP-PSTN Traffic and to add Percent VoIP Usage (PVU) factor language. On April 30, 2012, Sprint filed a request to withdraw the filing.

     TODAY, shall the Commission approve the withdrawal of this filing?

Items for Commission Discussion

1.      On May 4, 2012, pipeline safety staff filed a letter as an informational filing, 2012 Info PS01. The letter requests Commission guidance regarding pipeline penalties in light of legislation to take effect on July 1, 2012, that increases the penalty maximum.

Announcements

  1. An ad hoc commission meeting will be held Wednesday, May 2, 2012, at 10 a.m. CDT, in Room 413 at the State Capitol Building in Pierre, S.D.

  2. Commissioners and staff will meet with representatives of the Western Area Power Administration on Monday, May 7, 2012, at 9 a.m. CDT, in Room 430 at Lake Area Technical Institute, 1225 Arrow Ave., Watertown, S.D. The agenda is to discuss Western's policies and procedures in marketing and delivering hydroelectric power. A tour of Western's Watertown operations center will follow the meeting. Security clearance is required to tour the facility.

  3. Commissioners and staff will meet with representatives of Otter Tail Power Company and Xcel Energy on Tuesday, May 8, 2012, at 1:30 p.m. CDT, in Room 413 at the State Capitol Building, Pierre, S.D. The agenda is to discuss a project update for the companies' planned Brookings to Big Stone transmission line project.

  4. Commissioners and staff will meet with representatives of Knology of the Black Hills on Wednesday, May 16, 2012, at 2 p.m. MDT, at the Knology office, 809 Deadwood Ave., Rapid City, S.D. The agenda is to discuss company history and tour the Knology facility.

  5. An ad hoc commission meeting will be held Thursday, May 17, 2012, at 9:30 a.m. CDT, in Room 413 at the State Capitol Building in Pierre, S.D.

  6. The next regularly scheduled commission meeting will be held Tuesday, May 22, 2012, at 9:30 a.m. CDT, in Room 413 at the State Capitol Building, Pierre, S.D.

  7. The PUC offices will be closed Monday, May 28, 2012, in observance of Memorial Day.

  8. Commission meetings are scheduled for June 5 and 19, 2012.
