Electric

1.     EL14-083     In the Matter of the Joint Request by Otter Tail Power Company and Northern States Power Company dba Xcel Energy for Approval to Transfer Permit for 345kV Transmission Facilities to Joint Ownership  (Staff Analysts: Brian Rounds and Darren Kearney; Staff Attorney: Kristen Edwards)

On September 17, 2014, the Commission received a filing from Otter Tail Power Company (OTP) and Northern States Power Company dba Xcel Energy (Xcel) requesting approval to transfer permit ownership of 345kV transmission facilities to OTP and Xcel as joint permitees. The permit was granted to OTP and other utilities in Docket EL06-002. In that docket, the Commission also ordered the assessment of a filing fee in the amount of $102,500. In Docket EL12-045, the Commission ordered that ownership of the permit be transferred solely to OTP. The Commission accepted OTP's certification of the permit in Docket EL12-063. 

     TODAY, shall the Commission issue an order extending the filing fee ordered in EL06-002 to account for actual expenses incurred in the processing of EL14-083? AND, shall the Commission issue an order granting the request of OTP and Xcel to transfer permit ownership of the permit granted in EL06-002 to joint ownership between OTP and Xcel?

2.     EL14-084     In the Matter of the Request for Approval of an Electric Service Territory Boundary Agreement between Flandreau Municipal Electric and Sioux Valley-Southwestern Electric Cooperative, Inc. dba Sioux Valley Energy (Staff Analyst: David Henry; Staff Attorney: Kristen Edwards)

On September 24, 2014, Commission Staff filed an Electric Service Territory Boundary Agreement between Flandreau Municipal Electric and Sioux Valley-Southwestern Electric Cooperative, Inc. dba Sioux Valley Energy. This filing is made pursuant to current efforts of the PUC to verify electric territory mapping data for conversion to electronic format and use in a Geographic Information System (GIS) database. With the assistance of the above-referenced utilities, Commission Staff has confirmed the service territory boundary shared by these utilities and has prepared updated mapping information. Commission Staff asks for approval of the agreement to update official mapping data to properly reflect the service territory boundaries shared by the utilities in this docket.

     TODAY, shall the Commission approve the proposed electric service territory boundary agreement?

Gas & Electric

1.     GE14-001     In the Matter of the Filing by MidAmerican Energy Company for the Approval of Its Reconciliation for 2013 and its Proposed Energy Efficiency Plan for 2014 (Staff Analyst: Darren Kearney; Staff Attorney: Karen Cremer)

On February 27, 2014, the Commission received a filing from MidAmerican Energy Company (MidAmerican) that included its 2013 Energy Efficiency Annual Report, the reconciliation for the 2013 Energy Efficiency Cost Recovery Factor for the 2013 calendar year, and MidAmerican's 2014 Energy Efficiency Plan Update. MidAmerican requested approval of modifications to its 2014 Energy Efficiency Plan and Energy Efficiency Cost Recovery Rider, which included 2013 reconciliation amounts, the 2013 performance incentive and 2014 budget amounts. On May 2, 2014, the Commission issued an Order Approving MidAmerican's 2013 Energy Efficiency Annual Report and 2014 Energy Efficiency Plan Update. On October 10, 2014, MidAmerican filed a petition to update costs for its Energy Efficiency Plan. Specifically, MidAmerican requested the Commission authorize the additional spending of $537,622 in the Gas Residential Equipment Program in order to meet customer demand and continue program operation.

     TODAY, shall the Commission authorize MidAmerican to spend an additional $537,622 in the 2014 Gas Residential Equipment program, resulting in a revised 2014 budget of $1,377,165 for the program?

Telecommunications

1.     TC14-081     In the Matter of the Application of Crown Castle NG Central LLC for a Certificate of Authority to Provide Telecommunications Services in South Dakota (Staff Analyst: Joseph Rezac; Staff Attorney: Karen Cremer)

On September 25, 2014, the Commission received a filing from Crown Castle NG Central LLC (Crown Castle) requesting a Certificate of Authority to Provide Non-Switched Local Transport Services. On October 17, 2014, South Dakota Telecommunications Association (SDTA) filed a Petition to Intervene.

     TODAY, shall the Commission grant intervention to any party that may have filed?

Hydrocarbon Pipeline

1.     HP14-001     In the Matter of the Petition of TransCanada Keystone Pipeline, LP for Order Accepting Certification of Permit Issued in Docket HP09-001 to Construct the Keystone XL Pipeline (Staff Analysts: Brian Rounds and Darren Kearney; Staff Attorney: Kristen Edwards)

On September 15, 2014, the Commission received a filing from TransCanada Keystone Pipeline, LP (TransCanada) seeking an order accepting certification of the permit issued in HP09-001. The Commission issued an Amended Final Decision and Order granting a permit to TransCanada on June 29, 2010. Because it has been at least four years since the permit was issued, TransCanada now seeks an order accepting certification, per SDCL 49-41B-27. An intervention deadline of October 15, 2014, was set. The Commission received applications for party status from several entities and individuals. All applications for party status are posted in the docket and can be viewed at http://www.puc.sd.gov/Dockets/HydrocarbonPipeline/2014/hp14-001.aspx.

Announcements

  1. Commissioners and staff will meet with representatives of MISO on Friday, October 24, 2014, at 9:30 a.m. CDT in Room 413 at the State Capitol, Pierre, S.D. The agenda includes discussion of MISO's modeling response to the EPA's proposed plan to reduce carbon emissions from existing power plants. This meeting has been cancelled.

  2. A hearing is scheduled for Docket EL14-061 on Thursday, November 6, 2014, beginning at 9:00 a.m. CST in Room 414 at the State Capitol, Pierre, S.D.

  3. The PUC offices will be closed Tuesday, November 11, 2014, in observance of the Veterans Day holiday.

  4. The next regularly scheduled commission meeting will be Wednesday, November 12, 2014, at 1:30 p.m. CST in Room 413 at the State Capitol, Pierre, S.D.

  5. Commissioners and Staff will attend the National Association of Regulatory Utility Commissioners Annual Meeting, November 16-19, 2014, at the San Francisco Marriott, San Francisco, Calif.

  6. Commission meetings are scheduled for November 25 and December 9, 2014.
