MINUTES OF THE COMMISSION MEETING

Commissioner Jim Burg called the meeting to order at 3:00 p.m.  Present were Commissioner Laska Schoenfelder, Commissioner Pam Nelson, Executive Director Bill Bullard, General Counsel Rolayne Ailts Wiest, Fixed Utilities Division Director  Greg Rislov, Telecommunications Analyst Harlan Best, Utility Analysts Bob Knadle and Dave Jacobson, Engineer Martin Bettmann, Business Manager Sue Cichos,  Consumer Representative Leni Hook, and Administrative Secretary Shirleen Fugitt.

Also present were Rich Coit, SDITC; Dennis McFarland, Pam Communications; John Lovald, AT&T; Doug Eidahl, SDREA; and Dave Gerdes, MCI.

Joining the meeting by phone were Rod Bowar, Kennebec Telephone; Mary Lohnes, Midco Communications; Deb Hathaway and Scott Scofield, Pam Communications; Bill Heaston, Colleen Sevold, Jon Lehner, Roger Weiss and Larry Kenworthy, U S WEST Communications; Jim Wilcox, NSP; Mike Bradley, Kadoka Telephone; Robert Marmet, DCT; and Robert Kastelitz, AT&T. 

Leadership

1.         Election Of A Chairperson And Vice-Chairperson Of The Commission  (General Counsel:  Rolayne Ailts Wiest.)

Commissioner Nelson nominated Commissioner Burg for Chairperson.  Commissioner Schoenfelder seconded and Commissioner Burg concurred.  Motion passed 3-0.

Commissioner Schoenfelder nominated Commissioner Nelson for Vice-Chairperson.  Commissioner Burg seconded.  Commissioner Nelson concurred.  Motion passed 3-0.

Commissioner Burg will serve as Chairperson and Commissioner Nelson as Vice-Chairperson.

Administration

1.         Approval Of The Minutes Of The Commission Meeting of December 9, 1996, The Ad Hoc Commission Meeting of December 20, 1996; And The Commission Meeting Of December 31, 1996.  (Staff:  Shirleen Fugitt.)

Commissioner Schoenfelder moved to approve the minutes of the December 9, 1996, Commission Meeting, the December 20, 1996, Ad Hoc Commission Meeting and the December 31, 1996, Commission Meeting.  Commissioner Burg seconded.  Commissioner Nelson did not vote.  Motion passed 2-0.

Consumer Affairs

1.         Status Report On Consumer Utility Inquiries And Complaints Recently Received By The Commission.  (Consumer Representative:  Leni Hook.)

Ms. Hook presented an update on inquiries and complaints received since the last Commission meeting.           

Electricity

1.     EL96-021        IN THE MATTER OF THE COMPLAINT FILED BY RAYMOND AND BEVERLY NORDSTROM, SPEARFISH, SD, AGAINST BUTTE ELECTRIC COOPERATIVE, INC. AND BLACK HILLS POWER AND LIGHT REGARDING ELECTRICAL SERVICE TO CERTAIN LOTS IN MOUNTAIN SHADOWS MOBILE HOME PARK, SPEARFISH, SD.  (Staff Engineer:  Martin Bettmann.  Staff Attorney:  Karen Cremer.)

Mr. Bettmann requested deferral.  Action was deferred.

2.         EL97-001        IN THE MATTER OF THE FILING BY NORTHERN STATES POWER COMPANY FOR APPROVAL OF FUEL CLAUSE ADJUSTMENT.  (Staff Analyst:  Dave Jacobson.  Staff Attorney:  Karen Cremer.)

Jim Wilcox, NSP, explained the filing and requested approval.  Mr. Jacobson recommended approval.

Commissioner Schoenfelder moved to approve the fuel clause adjustment and waive the 30 day notice requirement.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.

Telecommunications

1.      TC96-196        IN THE MATTER OF THE FILING BY U S WEST COMMUNICATIONS, INC. FOR REVISIONS TO ITS EXCHANGE AND NETWORK SERVICES TARIFF AND EXCHANGE AND NETWORK SERVICES CATALOG.  (Staff Analyst:  Dave Jacobson.  Staff Attorney:  Camron Hoseck.)

Mr. Jacobson explained the filing and recommended approval.

Commissioner Schoenfelder moved to approve the filing.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.

2.           TC96-199        IN THE MATTER OF THE APPLICATION BY U S WEST INTERPRISE AMERICA, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA.  (Staff Analyst:  Dave Jacobson.  Staff Attorney:  Karen Cremer.)

Ms. Wiest recommended granting intervention to DCT, AT&T, SDITC, DTI and DTS.

Commissioner Schoenfelder moved to grant intervention to DCT, AT&T, SDITC, DTI and DTS.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.

3.             TC96-202        IN THE MATTER OF THE APPLICATION OF KENNEBEC TELEPHONE COMPANY, INC. FOR APPROVAL OF A BOUNDARY CHANGE WITH GOLDEN WEST COMMUNICATIONS, INC.  (Staff Analyst:  Martin Bettmann.  Staff Attorney:  Camron Hoseck.)

Mr. Bettmann explained the application and recommended approval.

Commissioner Schoenfelder moved to approve the application.  Chairman Burg seconded and Commissioner Nelson concurred.  Motion passed 3-0.

4.               TC96-204        IN THE MATTER OF THE FILING BY KADOKA TELEPHONE COMPANY AND GOLDEN WEST TELECOM FOR APPROVAL OF A NEW AND REVISED MAP OF TERRITORY BOUNDARIES.  (Staff Analyst:  Martin Bettmann.  Staff Attorney:  Camron Hoseck.)

Mr. Bettmann explained the filing.

Commissioner Schoenfelder moved to approve the filing.  Chairman Burg seconded and Commissioner Nelson concurred.  Motion passed 3-0.

5.       TC96-205        IN THE MATTER OF THE REQUEST BY PAM COMMUNICATIONS TO OFFER NEGOTIATED RATES.  (Staff Analyst:  Harlan Best.  Staff Attorney:  Camron Hoseck.)

Dave Gerdes addressed the request for intervention by MCI.  John Lovald addressed the intervention request by AT&T.  Ms. Wiest recommended granting intervention to AT&T.

Commissioner Schoenfelder moved to grant intervention to AT&T.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.

Ms. Wiest recommended granting late-filed intervention to MCI.

Commissioner Schoenfelder moved to grant late-filed intervention to MCI.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.

Discussion followed on whether a tariff filing should be required from PAM Communications.   

Commissioner Schoenfelder moved that the Executive Director set a procedural schedule in this matter.  Chairman Burg seconded and Commissioner Nelson concurred.  Motion passed 3-0.

6.           TC96-206        IN THE MATTER OF THE FILING BY U S WEST COMMUNICATIONS, INC. FOR REVISIONS TO ITS EXCHANGE AND NETWORK CATALOG.  (Staff Analyst:  Tammi Hendrix.  Staff Attorney:  Karen Cremer.)

Ms. Wiest recommended granting intervention to TCIC and MCI. 

Commissioner Schoenfelder moved to grant intervention to TCIC and MCI.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.

Commissioner Schoenfelder moved that the Executive Director set a procedural schedule in this matter.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.

The meeting was adjourned at 4:00 p.m.
