MINUTES OF THE AD HOC COMMISSION MEETING

Chairman Burg called the meeting to order at 11:00 a.m.  Present were Commissioner  Pam Nelson, Commissioner Laska Schoenfelder, Executive Director Bill Bullard, General Counsel Rolayne Ailts Wiest, Staff Attorney Karen Cremer, Fixed Utilities Division Director Greg Rislov, Telecommunications Analyst Harlan Best, Utilities Analysts Bob Knadle and Dave Jacobson, Consumer Representative Leni Healy and Administrative Secretary Shirleen Fugitt.  

Also present were Rich Coit, SDITC, and John Lovald, AT&T.

Joining the meeting by phone were Loren Hiatt, Michele Engel, Glenn Solomon and Rick Wolters, AT&T; Robert Marmet, DCT; Jon Lehner and Colleen Sevold, U S WEST; Brian Donahoe, Baltic Telecom Coop; Roger Specht, Gemini Companies; Gene LeBrun, U S WEST Interprise America; and Mary Lohnes and Tom Simmons, Midco Communications.

Telecommunications

1.              TC96-105        IN THE MATTER OF THE FILING BY U S WEST COMMUNICATIONS, INC. REGARDING TELECOMMUNICATIONS COMPANY CERTIFICATION.  (Staff Analyst:  Harlan Best.  Staff Attorney:  Camron Hoseck.)

Commissioner Nelson moved to grant late-filed intervention to Baltic Telecom Cooperative, Inc.  Commissioner Schoenfelder seconded and Chairman Burg concurred.  Motion passed 3-0.           

2.               TC96-199        IN THE MATTER OF THE APPLICATION BY U S WEST INTERPRISE AMERICA, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA.  (Staff Analyst:  Dave Jacobson.  Staff Attorney:  Karen Cremer.)

Gene LeBrun, representing U S WEST Interprise America, addressed the company's request to withdraw this application.

Commissioner Nelson moved to allow the withdrawal of the application and to close the docket.  Commissioner Schoenfelder seconded and Chairman Burg concurred.  Motion passed 3-0.

3.           TC96-184        IN THE MATTER OF THE INTERCONNECTION CONTRACT NEGOTIATIONS BETWEEN AT&T COMMUNICATIONS OF THE MIDWEST, INC. AND U S WEST COMMUNICATIONS, INC. PURSUANT TO 47 U.S.C. SECTION 252.  (Advisors to the Commission:  Commission Staff.)

Rick Wolters explained AT&T's motion to reconsider. 

Chairman Burg moved to consider AT&T's Motion to Reconsider.  Commissioner Nelson seconded and Commissioner Schoenfelder concurred.  Motion passed 3-0.    

After taking arguments from the parties, Commissioner Schoenfelder moved to take AT&T's Motion for Reconsideration/Modification of Order under advisement.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.

4.        TC97-005        IN THE MATTER OF THE FILING BY U S WEST COMMUNICATIONS, INC. FOR APPROVAL OF AN INTERCONNECTION COST ADJUSTMENT MECHANISM.  (Staff Analyst:  Harlan Best.  Staff Attorney:  Karen Cremer.)

John Lovald, AT&T, requested that data requests be answered within seven days. 

Commissioner Nelson moved to grant AT&T's motion for discovery and order that discovery be filed  within seven days.  Commissioner Schoenfelder seconded and Chairman Burg concurred.  Motion passed 3-0.

5.         TC97-006        IN THE MATTER OF THE FILING BY U S WEST COMMUNICATIONS, INC. FOR REVISIONS TO ITS EXCHANGE AND NETWORK SERVICES TARIFF.  (Staff Analyst:  Dave Jacobson.  Staff Attorney:  Camron Hoseck.)

Roger Specht, Gemini Companies, addressed the late-filed request for intervention.

Commissioner Schoenfelder moved to grant late-filed intervention to Gemini Companies.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.

6.     TC97-030        IN THE MATTER OF THE FILING BY DAKOTA COOPERATIVE TELECOMMUNICATIONS, INC., DAKOTA TELECOM, INC. AND DAKOTA TELECOMMUNICATIONS SYSTEMS, INC. FOR DESIGNATION AS ELIGIBLE TELECOMMUNICATIONS CARRIERS.  (Staff Analyst:  Harlan Best.  Staff Attorney:  Camron Hoseck.)

John Lovald addressed AT&T's request for intervention.

Commissioner Schoenfelder moved to grant intervention to AT&T and to instruct the Executive Director to set a procedural schedule.  Commissioner Nelson seconded and Chairman Burg concurred.  Motion passed 3-0.
