Minutes of Ad Hoc Commission Meeting

Chairman Gary Hanson called the meeting to Order. Present were: Commissioner Chris Nelson and Commissioner Kristie Fiegen; Commission Counsel: Rolayne Wiest; Commission Advisor: Greg Rislov; Staff Attorney: Karen Cremer; Staff Analysts: Bobbi Bourk and Staff: Demaris Axthelm

Also present were: Talbot Wieczorek, Gunderson, Palmer, Nelson & Ashmore, LLC, representing Sprint Communications Company, L.P.; Philip Schenkenberg, Briggs and Morgan, representing Sprint Communications Company L.P.; James Cremer, Bantz, Gosch & Cremer LLC, representing Northern Valley Communications, LLC and Sancom, Inc. Ross A Buntrock, Arent Fox LLP, representing Northern Valley Communications, LLC and Sancom, Inc.; Bob Riter, Riter, Rogers, Wattier and Northrup, representing South Dakota Network, LLC and James Groft, Northern Valley Communications, LLC

Telecommunications

1.      TC09-098           In the Matter of the Complaint filed by South Dakota Network, LLC against Sprint Communications Company L.P. Regarding Failure to Pay Intrastate Centralized Equal Access Charges and to Immediately Pay Undisputed Portions of SDN's Invoices (Staff Analyst: Bobbi Bourk, Staff Attorney: Karen Cremer) 

         A lengthy discussion took place among the parties and the Commission regarding Sprint's Amended Motion to Dismiss Northern Valley's Cross-Claim, Sprint's Amended Motion to Dismiss Sancom's Cross-Claim, Northern Valley's Motion to Compel and Northern Valley and Sancom's Motion for Adoption of Procedural Schedule which can be found on the PUC website under Commission Actions, Commission Meeting Archives, 2011, August 30, 2011, recording located at: http://www.puc.sd.gov/Archives/2011/default.aspx . After discussion of the Motion to Compel, Jim Cremer, representing Northern Valley Communications, LLC and Sancom Inc. stated that the companies have agreed to withdraw the Motion to Compel. After discussion of the Motion for Adoption of Procedural Schedule, the parties agreed to work on coming to an agreement on a procedural schedule and, if they were able to agree, would file a procedural schedule within eight days.

Commissioner Nelson moved to grant Sprint's Amended Motion to Dismiss Sancom's Cross-Claim and Sprint's Amended Motion to Dismiss Northern Valley's Cross-Claim.  Motion carried 2-1 Hanson dissented.

There being no further business, at the hour of 3:08 p.m., the South Dakota Public Utilities Commission meeting adjourned. The next Commission meeting is scheduled for September 13, 2011.
