EL05-001    In the Matter of the Filing by Navitas Energy Regarding its Notification of Intent to Apply for a Permit for an Energy Conversion Facility.

On January 13, 2005, Navitas Energy filed with the Commission a Notification of Intent to submit an application for a Permit for an Energy Conversion Facility. The proposed White Wind Farm will consist of up to 102 wind turbines to yield a net capacity of up to 200 MW. The preferred wind turbine will be a 2.0 MW machine with a rotor diameter between 80 90 meters. The turbines and associated facilities will be sited on land that is primarily used as grazing land southeast of the City of White, Brookings County, South Dakota.

EL05-002    In the Matter of the Joint Request for an Electric Service Rights Exception between Sioux Valley Southwestern Electric Cooperative, Inc. d/b/a Sioux Valley Energy and Lyon Rural Electric Cooperative, Inc

On January 13, 2005, Sioux Valley Energy filed for Commission approval an Agreement for Electric Service Territory Exception between Lyon Rural Electric Cooperative, Inc. (LREC), Rock Rapids, IA and Sioux Valley Southwestern Electric Cooperative, Inc. d/b/a Sioux Valley Energy (SVE). The agreement seeks an exception to the existing service territory allowing LREC to serve a new customer in SVE's territory. The new rural residential service is located in the West half of the Southwest quarter of the Southwest quarter of Section 32, Township 101 North, Range 47 West, in Minnehaha County, South Dakota.

TC05-001    In the Matter of the Application of Phone1, Inc. for a Certificate of Authority to Provide Alternative Operator Services in South Dakota.

On January 13, 2005, Phone1, Inc. filed an application seeking a Certificate of Authority to provide interexchange services throughout South Dakota. The Applicant intends to provide operator assisted services to call aggregator locations.

TC05-002    In the Matter of the Filing for Approval of a Master Services Agreement between Qwest Corporation and ACN Communication Services, Inc

On January 13, 2005, the Commission received a filing for the approval of Qwest's Master Services Agreement. Qwest Corporation and ACN Communications Services, Inc. have executed a commercial agreement related to the provisions of switching and shared transport. The Master Services Agreement is being filed in compliance with the Commission's Order dated October 29, 2004, in Docket TC04-144. In its cover letter Qwest stated that, "Qwest has disputed, and will continue to dispute, that the (Master Services) Agreement and similar commercial arrangements between Qwest and CLECs are ICAs that must be filed with the Commission for approval pursuant to Section 252 of the Act. Notwithstanding this position, and without waiving any of its rights or arguments on these issues, Qwest is filing the Agreement as set forth above. Qwest is making the filing solely to avoid further controversy or disputes with the Commission regarding the appropriate legal status of the Agreement. . . ." Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than February 2, 2005. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

TC05-003    In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and OrbitCom, Inc.

On January 14, 2005, the Commission received a filing for the approval of an Amendment to the Interconnection Agreement for Elimination of UNE-P and Implementation of Batch Hot Cut Process and Discounts between Qwest Corporation and OrbitCom, Inc. According to the parties, the Amendment is filed to address uncertainty and create a stable arrangement. Any party wishing to comment on the Amendment may do so by filing written comments with the Commission and the parties to the Amendment no later than February 3, 2005. Parties to the Amendment may file written responses to the comments no later than twenty days after the service of the initial comments.

TC05-005    In the Matter of the Application of Northstar Telecom, Inc. for a Certificate of Authority to Provide Interexchange Telecommunications Services and Local Exchange Services in South Dakota.

On January 19, 2005, Northstar Telecom, Inc. submitted an application for a Certificate of Authority to provide interexchange and local exchange telecommunication service in South Dakota. Northstar intends to provide facilities based 1+ and 101XXXX outbound dialing, 800/888 toll free inbound dialing, calling cards, and data services, as well as, local exchange service for business and residential customers. Northstar intends to provide interexchange service throughout South Dakota and local exchange service throughout the state in the areas served by Qwest.
