COMPLAINT

CT05-006    In the Matter of the Complaint filed by South Dakota Network, LLC against Global Crossing Telecommunications, Inc. Regarding Access Charges.  

On July 18, 2005, South Dakota Network, LLC (SDN) filed a complaint against Global Crossing Telecommunications, Inc. (Global Crossing). SDN is seeking payment for unpaid intrastate centralized equal access services provided to Global Crossing. SDN requests that the Commission order Global Crossing to pay the intrastate centralized equal access invoice plus late payment penalties, to reimburse SDN's attorney's fees pursuant to SDCL 49-13-14.1, for pre-judgment interest and post-judgment interest on the unpaid balances, and to grant SDN such other and further relief that may be proper or equitable.

NATURAL GAS

NG05-008    In the Matter of the Application of NorthWestern Corporation d/b/a NorthWestern Energy for Approval of Tariff Revisions.

Application by NorthWestern Energy for approval of a new service offering that would allow customers to lock-in their winter natural gas supply price. The service would be available to commercial and industrial customers including schools and hospitals which have requested fixed gas supply prices during the heating season. Prices would be locked-in from November through April.

TC05-102     In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and AT&T Communications of the Midwest, Inc.

On July 14, 2005, the Commission received a filing for approval of a Collocation Joint Inventory Visit Amendment No. 3 to the Interconnection Agreement between Qwest Corporation and AT&T Communications of the Midwest, Inc. According to the parties, this Amendment revises the Interconnection Agreement between the parties, which was approved by the Commission on May 13, 2004, in Docket TC04-080. Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than August 3, 2005. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

TC05-103     In the Matter of the Filing for Approval of an Amendment to an Interconnection Agreement between Qwest Corporation and VCI Company.  

On July 14, 2005, the Commission received a filing for approval of a Triennial Review Order and Triennial Review Remand Order Amendment to the Interconnection Agreement between Qwest Corporation and VCI Company a/k/a Vilaire Communications. According to the parties, this Amendment revises the Interconnection Agreement which was approved by the Commission on April 7, 2005, in Docket TC05-032. Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than August 3, 2005. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

According to the parties, this Amendment adds terms, conditions and rates for Line Splitting. On July 14, 2005, the Commission received a filing for approval of a Triennial Review Order and Triennial Review Remand Order Amendment to the Interconnection Agreement between Qwest Corporation and Northstar Telecom, Inc. a wholly owned subsidiary of Midwest Marketing Group, Inc. According to the parties, this Amendment incorporates the Triennial Review Order and Triennial Review Remand Order into the already existing Interconnection Agreement. Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than August 3, 2005. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

According to the parties, this Agreement sets up the terms and conditions for interconnection, unbundled network elements, ancillary services and resale of telecommunications services. TC05-108     In the Matter of the Application of BellSouth Long Distance, Inc. for a Certificate of Authority to Provide Local Exchange Services in South Dakota.

On July 20, 2005, BellSouth Long Distance, Inc. filed an application for a Certificate of Authority to provide local exchange telecommunications service in South Dakota. The applicant proposes to offer local exchange service by utilizing a combination of unbundled network elements and resold services obtained from other local exchange carriers. BellSouth will offer service through interconnections and commercial agreements utilizing the facilities of Qwest Corporation.
