EL10-005        In the Matter of the Petition of Otter Tail Power Company for Extension of Test Period

         On May 17, 2010, the Commission received an application by Otter Tail Power Company (OTP) requesting extension of time beyond test period to file application for increase in rates. OTP requests to be allowed to file a general rate increase application on or before August 31, 2010, based on a calendar year 2009 test period. ARSD 20:10:13:44 requires the use of a test period consisting of 12 months of actual experience ending no earlier than six months before the date of filing unless good cause for extension is shown. OPT requests the extension because of efficiencies gained in the concurrent use of the test period in a Minnesota general rate increase filing. OTP also states a calendar year test period will simplify the filing efforts for OTP, will assist the Commission Staff in verifying OTP's financial status, and will cause the basis of rates charged to South Dakota customers to reflect proper levels of costs.

OC10-002       In the Matter of the Petition of South Dakota Association of Rural Water Systems for a Declaratory Ruling

         On May 19, 2010, South Dakota Rural Water Systems filed a Petition for a Declaratory Ruling asking the One Call Board for an interpretation of SDCL 49-7A-8. Specifically, the following questions of law were asked: (i) regardless of depth of an underground facility, it is a violation of SDCL 49-7A-8 to bury an underground facility within eighteen inches horizontally on either side form the markings of another underground facility if hand tools or other noninvasive tools are not used; and, (ii) do South Dakota statutes and administrative rules allow rural water systems to mark the outside edge of the pipe in two places and mark with spray paint of flags the center of the pipe in order to ensure an excavator maintains a minimum horizontal clearance of eighteen inches from the markings on both sides of the outside edge?

TC10-029        In the Matter of the Filing for Approval of a Wireline Interconnection Agreement Between MCC Telephony of the Midwest, LLC and Brookings Municipal Utilities d/b/a Swiftel Communications for the State of South Dakota

         On May 14, 2010, the Commission received a filing for approval of a wireline interconnection agreement between MCC Telephony of the Midwest, LLC and Brookings Municipal Utilities, d/b/a Swiftel Communications for the state of South Dakota. Any party wishing to comment may do so by filing written comments with the Commission and the parties to the Agreement no later than June 3, 2010. Parties to the Agreement may file written responses to the comments no later than twenty days after the service of the initial comments.

TC10-030        In the Matter of the Request of Kennebec Telephone Company for Certification Regarding Its Use of Federal Universal Service Support

         On May 18, 2010, the Commission received an application from Kennebec Telephone Company requesting the Commission to issue a certification to the FCC and USAC indicating it is in compliance with 47 U.S.C., Section 254(e) and should receive all federal universal service support determined for distribution to the Company in 2011.
