 MINUTES OF THE COMMISSION HEARING 

Chairman Dustin Johnson called the meeting to order.  Present were Vice Chairman Gary Hanson; Commissioner Steve Kolbeck; Deputy Executive Director Heather Forney; Commission Advisor Greg Rislov;  Commission Attorney John Smith; Staff Attorney Karen Cremer; Staff Analyst Harlan Best; and Administrative Secretary Demaris Axthelm. 

Telecommunications 

TC06-204 - In the Matter of SkyTel Communications, Inc.'s Failure to Submit a Report and Pay the Gross Receipts Tax

TC06-205 - In the Matter of CI2, Inc.'s Failure to Submit a Report and Pay the Gross Receipts Tax

TC06-206 - In the Matter of BAK Communications, LLC's Failure to Submit a Report and Pay the Gross Receipts Tax  

TC06-207 - In the Matter of Exergy Group, LLC's Failure to Submit a Report and Pay the Gross Receipts Tax

TC06-214 - In the Matter of WDT World Discount Telecommunications Co.'s Failure to Pay the Gross Receipts Tax  

        Ms. Heather Forney testified that the Commission should revoke the Certificates of Authority for the above companies listed in the first section of attached Exhibit 1.  Ms. Forney stated the companies have been contacted numerous times through the mail.  She also indicated that 2 companies (National Access Long Distance, Inc. (TC06-212) and WDT World Discount Telecommunications Co. (TC06-214),) have paid their gross receipts tax, so they are now in compliance.  Ms. Forney recommended that Dockets TC06-212 and TC06-214 be dismissed.  Ms. Cremer recommended that the Commission revoke Certificates of Authority for the companies in Dockets TC06-204, TC06-205, TC06-206, TC06-207, TC06-208, TC06-209, TC06-210, TC06-211, and TC06-213 for failure to pay the Gross Receipts Tax for 2006.   

     Chairman Johnson moved to consolidate Dockets TC06-204, TC06-205, TC06-206, TC06-207, TC06-208, TC06-209, TV06-210, TC06-211, TC06-212, TC06-213 and TC06-214 for purposes of this hearing.  Vice Chairman Hanson seconded and Commissioner Kolbeck concurred.  Motion passed 3-0

         Chairman Johnson moved to dismiss Dockets TC06-212 and TC06-214.  Vice Chairman Hanson seconded and Commissioner Kolbeck concurred. Motion passed 3-0.

     Commissioner Kolbeck moved to revoke the Certificates of Authority for the companies named in Dockets TC06-204, TC06-205, TC06-206, TC06-207 TC06-208, TC06-209, TC06-210, TC06-211 and TC06-213.  Vice Chairman Hanson seconded and Chairman Johnson concurred.  Motion passed 3-0.
